Article 1 – Definitions
- Additional contract: a contract under which the consumer acquires extra digital tickets, products and/or services in connection with a distance contract and these are supplied by Sagrada Tickets or by a third party on the basis of an agreement between Sagrada Tickets and that third party.
- Reflection period: the period within which the consumer may exercise his right of withdrawal insofar as that right is legally available (see Article 5).
- Consumer: the natural person who is acting for purposes outside his trade, business, craft or profession.
- Day: calendar day.
- Long‑term contract: a contract for the regular supply of digital content, products and/or services for a defined period.
- Digital content: data produced and supplied in digital form, such as PDF tickets or QR codes.
- Right of withdrawal: the consumer’s option to cancel the distance contract within the reflection period, where legally permitted.
- Durable data carrier: any tool that enables the consumer or entrepreneur to store information addressed personally to him in a way that allows future consultation or use for a period adequate to the purpose of the information, and which allows the unchanged reproduction of the stored information (e.g., e‑mail).
- Distance contract: a contract concluded between Sagrada Tickets and the consumer within the framework of an organised system for distance selling (website, app) whereby only one or more means of distance communication are used up to and including the conclusion of the contract.
- Entrepreneur: Sagrada Tickets S.L., which offers digital entry tickets for the Sagrada Família and any related services via sagradaticket.com.
- Means of distance communication: a method that can be used for concluding a contract without the simultaneous physical presence of the entrepreneur and the consumer.
- Model withdrawal form: the European model withdrawal form included in Annex I to these terms. The form need not be provided if the consumer has no right of withdrawal (e.g., dated events).
Article 2 – Scope of Application
- These terms apply to every offer by Sagrada Tickets and to every distance contract concluded between Sagrada Tickets and the consumer.
- The text of these terms is made available to the consumer electronically before or at the conclusion of the distance contract in such a way that the consumer can store it on a durable data carrier. If this is not reasonably possible, Sagrada Tickets will indicate where the terms can be consulted electronically and that they will be sent free of charge upon request.
- If, in addition to these terms, specific product or service terms apply, the consumer may invoke the most favourable provision in the event of conflicting clauses.
Article 3 – The Offer
- If an offer has a limited validity period or is subject to conditions (e.g., dynamic pricing or specific time slots), this will be stated explicitly.
- The offer contains a complete and accurate description of the tickets, services and any additional products offered so the consumer can make a proper assessment.
- Each offer clearly states the rights and obligations attached to acceptance (such as date, time slot, cancellation / change policy, price, payment method and ticket delivery method).
Article 4 – The Contract
- The contract is concluded at the moment the consumer accepts the offer online and fulfils the conditions set out therein.
- Sagrada Tickets immediately confirms receipt of acceptance electronically. Until that confirmation is sent, the consumer may cancel the contract.
- Sagrada Tickets takes appropriate technical and organisational measures to secure electronic data transfer and ensures a secure web environment. Appropriate security measures are taken for electronic payment options.
- Within the statutory framework, Sagrada Tickets may verify whether the consumer can meet his payment obligations and consider factors relevant to responsibly concluding the distance contract.
- No later than upon delivery of the digital ticket(s), Sagrada Tickets provides the following information on a durable data carrier:
- Sagrada Tickets’ business address for complaints;
- The conditions under which and the manner in which the consumer can exercise any right of withdrawal, or a clear statement that the right is excluded (see Article 5);
- Information on existing after‑sales service and guarantees, if applicable;
- The price including taxes, any surcharges and the chosen method of payment;
- The term of the contract and the conditions for termination if it is a long‑term transaction.
- If applicable: the model withdrawal form.
Article 5 – Right of Withdrawal
- Pursuant to Article 16(l) of Directive 2011/83/EU, the right of withdrawal is excluded for leisure activities that take place on a specific date or within a specific period. Tickets for the Sagrada Família fall under this exception. The consumer therefore has no right of withdrawal once the booking is completed.
- Please check all personal details (name, e‑mail, chosen date/time slot) carefully before payment. Amendments may not be possible after purchase.
- If Sagrada Tickets voluntarily offers a more flexible cancellation/change option (e.g., flex tickets), it will be stated explicitly in the offer.
Article 6 – Price
- During the validity period stated in the offer, ticket prices will not be increased except for changes in VAT rates or if dynamic pricing is applied by the event provider (Sagrada Família).
- Prices are displayed inclusive of VAT and service/booking fees unless stated otherwise.
- Any refunds (e.g., if a time slot is cancelled by the venue) are processed via the same payment method.
Article 7 – Performance and Additional Guarantee
- Sagrada Tickets guarantees that the delivered services and tickets comply with the contract, the specifications stated in the offer and reasonable requirements of reliability and usability.
- Any additional guarantee offered by Sagrada Tickets, its supplier or manufacturer never limits the consumer’s legal rights.
Article 8 – Delivery and Execution
- After payment, tickets are generally delivered automatically and immediately by e‑mail in the form of a PDF file or mobile QR code. The consumer is responsible for correct receipt (check spam).
- The risk of loss or misuse of the ticket(s) passes to the consumer once they are delivered to the provided e‑mail address.
- If automatic delivery is delayed due to a technical issue, Sagrada Tickets will inform the consumer within 24 hours and still send the tickets or provide an alternative.
- Admission to the Sagrada Família requires presentation of the digital ticket (printed or on a mobile phone) along with valid ID.
Article 9 – Long‑Term Contracts: Duration, Termination & Renewal
The sale of admission tickets is a one‑off transaction. Article 9 only applies if Sagrada Tickets offers subscriptions or membership programmes for regular supply of tickets or services. In that case:
- Fixed‑term contracts will not be tacitly renewed for another fixed term.
- Contracts for an indefinite period may be terminated by the consumer at any time free of charge with one month’s notice.
- The consumer may terminate by the same method used to conclude the contract.
Article 10 – Payment
- Payment must be made immediately during the ordering process. Payment options include credit card, iDEAL, PayPal, Google Pay or Apple Pay (availability depends on country and currency).
- The consumer must report inaccuracies in payment data to Sagrada Tickets without delay.
- In the event of failed or reversed payments, we reserve the right to invalidate the tickets.
Article 11 – Complaints Procedure
- Complaints about the performance of the contract must be submitted fully and clearly described within a reasonable time via support@sagradaticket.com.
- Sagrada Tickets operates an internal complaints procedure and will respond within 14 days of receipt. If a complaint requires a foreseeable longer handling time, an acknowledgement and indication of the response time will be sent within 14 days.
- The consumer allows Sagrada Tickets at least four weeks to resolve the complaint amicably before a dispute arises.
Article 12 – Disputes
Contracts between Sagrada Tickets and the consumer to which these terms relate are governed exclusively by Spanish law. Disputes may be submitted to the competent court in Barcelona, without prejudice to the consumer’s right to use the European ODR platform (ec.europa.eu/consumers/odr).
Article 13 – Additional or Deviating Provisions
Additional or deviating provisions may not be detrimental to the consumer and must be recorded in writing or on another durable data carrier.
Article 14 – Delivery Time
In 98 % of cases you will receive your tickets immediately after payment. Should automatic issuance be temporarily unavailable, we guarantee delivery within 24 hours. In the exceptional event that delivery takes longer, you will be notified by e‑mail and you are entitled to cancel free of charge with a full refund.
